Terms of sale
Last updated 6 November 2026
This page has 12 highlighted gaps still to fill in.
These terms apply when you buy an artwork through this website. Please read them before you buy. They don’t affect your legal rights as a consumer.
1. Who I am
I’m [GAP: your full legal name], an artist and sole trader trading as [GAP: your trading or studio name, or your own name if you don’t use one]. My address is [GAP: the business address you’ll show publicly (not a PO box)], and you can email me at you@example.com.
[GAP: If you are VAT registered, add “My VAT number is …” here. If not, delete this line.]
Throughout these terms, “I”, “me” and “my” mean [GAP: your full legal name], and “you” means the person buying the artwork.
2. Who these terms are for
These terms are for people buying as consumers, not for business purchases. I sell to customers in [GAP: “the UK only” or “the UK and internationally”].
3. The artworks
- Every original artwork is one of a kind. Once it’s sold, it’s gone.
- I photograph each piece in natural light and describe it as accurately as I can. Colours can look slightly different on different screens, and handmade work has natural variations in texture and surface. These are part of the work and aren’t faults.
- Sizes are given in centimetres, height × width, for the artwork itself, without a frame unless the listing says otherwise. They may vary by a few millimetres.
- Unless the listing says otherwise, artworks are sold unframed. Works on paper may be supplied [GAP: e.g. “mounted and in a protective sleeve” or “unmounted”].
4. Prices and payment
- Prices are in pounds sterling (£).
- [GAP: Choose one. “I’m not VAT registered, so no VAT is charged.” OR “Prices include VAT.”]
- Delivery costs are shown before you pay. See my Delivery & returns policy.
- Payment is taken securely by Stripe. I never see or store your card details.
- If I’ve made an obvious mistake in a price or description, I’ll contact you before dispatch. You can then go ahead at the correct price or cancel for a full refund.
5. When your order is confirmed
Our contract starts when your payment goes through and Stripe sends you a confirmation email.
Occasionally a piece may be sold elsewhere at the same moment (for example, at an exhibition). If that happens, I’ll tell you as soon as I can and refund you in full within 14 days.
6. Delivery
I’ll deliver your artwork as set out in my Delivery & returns policy. The artwork is your responsibility once it’s delivered to you or to someone you’ve nominated. It becomes yours once I’ve received payment in full.
7. Your right to change your mind
You can cancel your order for any reason within 14 days of receiving your artwork. The Delivery & returns policy explains how to cancel, how returns work and when you’ll be refunded.
This right doesn’t apply to commissioned work made to your specifications. My Commission terms explain how commissions work.
8. If something is wrong with your artwork
Under the Consumer Rights Act 2015, goods must be as described, fit for purpose and of satisfactory quality. If your artwork arrives damaged or isn’t as described:
- please email me at you@example.com as soon as possible, with photos of the artwork and packaging;
- within 30 days of delivery, you can reject it for a full refund, including the original delivery cost and the cost of returning it to me;
- after 30 days, you’re entitled to a repair or, where that isn’t possible, a refund.
Because each artwork is unique, I can’t usually replace it like-for-like, so a refund or repair is the most likely solution.
For more about your rights, see Citizens Advice at citizensadvice.org.uk.
9. Copyright
When you buy an artwork, you own the physical piece. I keep the copyright, and I’m entitled to be identified as the artist, under the Copyright, Designs and Patents Act 1988. This means:
- you’re welcome to photograph the artwork and share photos on social media or in your home for personal, non-commercial use. A credit to [GAP: your trading or studio name, or your own name if you don’t use one] is always appreciated;
- you may not make prints, cards or other copies, or use images of the work commercially, without my written permission;
- I may continue to show images of the artwork in my portfolio, on social media and in promotional material, and may sell prints of it [GAP: delete “and may sell prints of it” if you never make prints of sold originals].
10. My responsibility to you
If I don’t keep to these terms, I’m responsible for loss or damage you suffer that was a foreseeable result. I don’t exclude or limit my liability where it would be unlawful to do so, including for death or personal injury caused by my negligence, or for fraud.
I sell to consumers for private use. I’m not responsible for any business losses.
11. Your personal information
I use your details only to fulfil your order and as set out in my Privacy policy.
12. Complaints
If you’re unhappy with anything, please email me at you@example.com and I’ll do my best to put it right. I aim to reply within [GAP: number] working days.
13. The law that applies
These terms are governed by the law of [GAP: “England and Wales”, “Scotland” or “Northern Ireland”, wherever you’re based]. If you live in another part of the UK, you can bring legal proceedings in your local courts.
14. Changes to these terms
I may update these terms from time to time. The version on this website when you placed your order is the one that applies to it.
